These Terms of Service (“Terms”) govern your access to and use of rtime (“the Service”), operated by the rtime project (“we”, “us”, or “our”), available at rtime.app. By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service

rtime is a group schedule-polling web application that allows users to create polls, share them with others, and visualize availability overlap to find meeting times. The Service is provided free of charge. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

2. Eligibility

You must be at least 13 years old to use the Service. By using rtime you represent that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Accounts and guest access

You may use parts of the Service as a guest without creating an account, by providing a display name and optionally an email address. You are responsible for keeping your account credentials and any secret poll-management or response-edit links confidential.

If you sign in via a third-party provider (Google, Microsoft), your use of those services is also governed by their respective terms of service.

4. Acceptable use

You agree not to use the Service to:

Post content that is unlawful, harassing, defamatory, or otherwise objectionable.
Impersonate another person or entity.
Attempt to circumvent rate limits, CAPTCHAs, or other abuse-prevention measures.
Scrape, crawl, or use automated tools to access the Service in a manner that places unreasonable load on our infrastructure.
Probe, scan, or test the vulnerability of the Service without our prior written consent.
Use the Service for any commercial purpose without our prior written consent.
Transmit spam, malware, or any content designed to harm users or systems.

We reserve the right to suspend or terminate access for any violation of these rules, without prior notice.

5. Your content

You retain ownership of any content you submit (poll titles, descriptions, availability data). By submitting content, you grant us a limited licence to store, display, and process it solely to operate the Service.

You are solely responsible for the content you submit. Do not include sensitive personal data (health information, financial data, government IDs, etc.) in poll titles or descriptions.

6. Data expiry and deletion

Polls and all associated data are automatically and permanently deleted after the poll's end date plus a grace period (currently 14 days). We do not guarantee the preservation of any poll or response data. Do not use rtime as a long-term record of availability information.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual property

The rtime application code, design, and branding are our property or licensed to us. Nothing in these Terms transfers any intellectual property rights to you. You may not reproduce, distribute, or create derivative works from the Service without our prior written consent.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED $100 USD.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Changes to these Terms

We may update these Terms at any time by posting the revised version at this URL with an updated date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
